These Terms of Use ("Terms") govern your access to and use of The Balanced Bowl mobile application (the "App") operated by The Balanced Bowl ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Educational and Informational Use Only
The App is provided strictly for educational and entertainment purposes. All recipes, nutrient calculations, ingredient suggestions, and nutritional information generated by the App are intended as general guidance and informational resources only.
The App is not a substitute for professional veterinary advice, diagnosis, or treatment. Every dog has unique health needs. If your dog has any illness, medical condition, allergy, food sensitivity, or special dietary requirement, you should consult a licensed veterinarian or board-certified veterinary nutritionist before making changes to your dog's diet. We strongly encourage all users to seek veterinary guidance when planning meals for their pets.
We do not guarantee that any recipe or nutritional information provided by the App is complete, accurate, or appropriate for your specific dog. You assume all responsibility for any dietary decisions you make based on information from the App.
2. Not Veterinary Advice
Nothing in the App should be construed as veterinary advice or a recommendation for the treatment or management of any health condition. The App does not diagnose, treat, cure, or prevent any disease or condition in animals.
If your dog shows signs of illness, changes in appetite, digestive issues, allergic reactions, or any other health concerns, discontinue use of any recipe from the App and contact your veterinarian immediately.
3. Eligibility
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you represent that you have obtained parental or guardian consent.
4. Account Registration
To access certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
5. Subscriptions and Payments
The App offers auto-renewable subscription plans ("The Balanced Bowl Pro") that unlock additional features:
- Monthly — $3.99 per month
- Annual — $24.99 per year
Subscriptions are billed through your Apple App Store account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
Free trial periods, if offered, will automatically convert to a paid subscription at the end of the trial unless cancelled at least 24 hours before the trial expires. Any unused portion of a free trial will be forfeited upon purchasing a subscription.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App.
- Interfere with, disrupt, or create an undue burden on the App's servers, networks, or infrastructure.
- Use automated scripts, bots, or other tools to access or interact with the App.
- Reproduce, distribute, modify, or create derivative works based on the App without our express written permission.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
7. Intellectual Property
The App and all content, features, and functionality — including but not limited to text, graphics, logos, icons, images, recipes, algorithms, software, and the overall design — are owned by The Balanced Bowl or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, or distribute any content from the App without our prior written consent.
8. User Content
Any data you submit to the App (pet profiles, preferences, saved recipes) remains yours. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, store, and process that content solely to provide and improve the App's services, as described in our Privacy Policy.
9. Third-Party Services
The App may link to or integrate with third-party services such as Instacart, Amazon, My Pet Carnivore, and Raw Feeding Miami. These services are governed by their own terms and privacy policies. We are not responsible for the content, accuracy, availability, or practices of any third-party service.
10. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY NUTRITIONAL INFORMATION, RECIPES, OR OTHER CONTENT PROVIDED THROUGH THE APP.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APP AND ANY RECIPES OR NUTRITIONAL INFORMATION IS AT YOUR SOLE RISK. THE APP IS AN EDUCATIONAL TOOL AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR YOUR PET'S DIET WITHOUT INDEPENDENT VERIFICATION BY A QUALIFIED VETERINARY PROFESSIONAL.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE BALANCED BOWL, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, OR ANY DAMAGES RELATED TO YOUR PET'S HEALTH OR WELLBEING, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless The Balanced Bowl and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
We may suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will continue to apply.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in California.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
16. Apple-Specific Terms
If you access the App through the Apple App Store, you acknowledge and agree that:
- These Terms are between you and The Balanced Bowl, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the App infringes a third party's intellectual property rights, The Balanced Bowl, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
